Doctors vs. Patanjali Heats Up! Court Scolds Medical Association for Media Interview

A recent turn of events has shaken things up in the ongoing legal battle between the Indian Medical Association (IMA) and Patanjali Ayurved. The Supreme Court, which was initially hearing a petition filed by the IMA against Patanjali’s allegedly misleading advertisements, has now turned its attention to the IMA itself.

The Backstory: IMA vs. Patanjali

In November 2023, the IMA filed a petition with the Supreme Court. The petition challenged the marketing practices of Patanjali Ayurved, a well-known Indian company that manufactures Ayurvedic products. The IMA argued that Patanjali’s advertisements were misleading and disparaged allopathy (modern medicine) while promoting their Ayurvedic products with unproven claims of curing diseases.

The court initially appeared to side with the IMA, cautioning Patanjali against making “false” and “misleading” claims. Patanjali and its co-founder, yoga guru Ramdev, were subsequently ordered to issue a public apology for their advertisements.

The Plot Twist: Interview Ignites Court’s Ire

Just when things seemed settled, a new wrinkle emerged in the case. The court’s attention shifted to an interview given by Dr. RV Asokan, the then-president of the IMA. In the interview, Dr. Asokan commented on the ongoing case with Patanjali. These public statements by the IMA president did not sit well with the judges.

The Supreme Court took offense to Dr. Asokan’s interview, considering it a subjudice comment. Subjudice refers to any activity that could prejudice or influence the outcome of a court case. By publicly discussing the case, the court felt the IMA might be trying to sway public opinion in their favor.

Court Grills the IMA

The court’s displeasure with the IMA was evident during a hearing. The bench comprising Justices Hima Kohli and A Amanullah sharply questioned the IMA’s stance. They highlighted the contradiction between the IMA’s criticism of Patanjali’s public pronouncements and Dr. Asokan’s own interview.

The IMA’s lawyer attempted to defend the organization, claiming Dr. Asokan’s comments were unintentional. However, the court remained unconvinced. They expressed concern about the potential damage caused by Dr. Asokan’s statements.

Impact and Future Developments

This turn of events has added a new layer of complexity to the legal battle. The court’s reprimand of the IMA serves as a reminder that both parties must adhere to subjudice rules. It remains to be seen how this development will affect the final verdict in the case.
